Are you ready for registration with the Care Quality Commission?
From 1 October 2010, adult social care and independent healthcare providers that carry on regulated activities must be registered with the Care Quality Commission (CQC).
Existing independent healthcare and adult social care providers that are not currently required to be registered under the Care Standards Act 2000 but, provide regulated activities, must complete the registration process for the first time under the new Health and Social Care Act 2008. To be registered, providers must show they are meeting new essential standards of quality and safety in all of the regulated activities they provide.
How do I decide if I need to register or not?
Check CQC’s ‘Scope of registration’ document, which can be found on www.cqc.org.uk/scopeofregistration. If this does not answer your queries, contact the CQC National Contact Centre on 03000 616161 or email enquiries@cqc.org.uk.
Registration application process
Those providers that are required to register for the first time under the Health and Social Care Act 2008 are advised to submit an application on or before 1 August 2010. If an application is received after this date, it will be processed, however, there is no guarantee it will be completed by 1 October 2010. This means that late applicants may not be registered by 1 October 2010 and if they continue to provide services, they will be doing so illegally.
The application process for providers currently registered under the Care Standards Act 2000 is currently open until 30 September 2010. CQC will be asking some of these providers to make their registration applications within a specified 28 day ‘application window’ during this period.
Revised enforcement policy consultation
To incorporate new changes to its enforcement powers made under legislation passed in April 2010, CQC is currently revising its enforcement policy.
The proposed changes relate to ‘Warning Notice’ arrangements, and ‘Compliance Actions’ and ‘Improvement Actions’ have been added to its possible regulatory responses. CQC’s basic approach and the enforcement principles remain unchanged from the existing policy.
The consultation runs until Tuesday 31 August 2010. Details of how to respond can be found on the website at www.cqc.org.uk/getinvolved/consultations/enforcementpolicy.cfm
The final enforcement policy is planned for publication on 1 October 2010.
CQC’s enforcement policy is a key element in its approach to the regulation of health and adult social care, so please take the time to consider the proposals and respond.
